License; Copyright. BOSS Controls authorizes use of this website (“Website”) and the information, documents, software, and products contained on this Website (collectively, “Materials”) and certain services (“Services”), subject to the terms contained herein. BOSS Controls reserves the right to change these Terms of Use without notice for any reason, including (without limitation) for any errors, inaccuracies, and omissions. Use of the Materials or Services constitutes acceptance of these terms, and such other guidelines or rules incorporated by reference (together, Terms of Use), posted on the Website at the time of such use. Breach of the Terms of Use terminates any authorization to use this Website and the Materials, and requires the destruction of any Materials downloaded or printed from this Website.

The Materials and Services are protected by copyright and/or other intellectual property laws, and by international treaty provisions. Any unauthorized use of the Materials or Services may violate such laws and shall constitute infringement or misappropriation of BOSS Controls intellectual property rights. Except as expressly provided herein, no right or license is granted to any patents, copyrights, Marks, or trade secrets by implication or otherwise.

Use of Software. Use of any software provided by BOSS Controls or provided upon authorization of BOSS Controls shall be governed by the applicable End User License Agreement (EULA). Should you not agree to the terms of the EULA, you should not use any Software provided by this Website nor download any Software.

Use of Materials (exclusive of Software). BOSS Controls authorizes the viewing, downloading, and printing of the Materials (exclusive of Software, except as provided above). Use of such materials is subject to the following conditions:

1. The use of such materials is personal in nature and not for resale or commercial use;

3. There shall be no removal of any proprietary notices, including copyright notices;
4. There shall be no transfer of title; and
5. BOSS Controls may revoke the use of such materials for any reason or no reason at all at any time.

Notwithstanding the foregoing, the design and layout of this Website, and the elements contained therein, are protected by copyright and/or other intellectual property laws, and by international treaty provisions, and may not be copied or imitated, or translated, de-compiled, disassembled, or reverse engineered, in whole or in part, except to the extent necessary to achieve interoperability with independently created programs, provided, however, that the information needed has not been made available by BOSS Controls after reasonable request.

None of the results obtained from the Software nor the Materials should be stored in a database or retrieval system without the prior written permission of BOSS Controls.

You agree that you will not use this Website or any other Website of BOSS Controls to infringe BOSS Controls’s intellectual property rights or the intellectual property rights of a third-party. Governing Law. This Website (excluding any linked third-party websites) is controlled by BOSS Controls from its corporate offices in Ligonier, Pennsylvania, within the United States of America. All matters related to access shall be commenced within one (1) year after the claim or cause of action arises and shall be governed by the laws of the Commonwealth of Pennsylvania, without regard to Conflict of Law Principles and the United Nations Convention on Contracts for the International Sale of Goods. All parties that use this Website and the Materials and Services shall submit to the jurisdiction and venue of the state and federal courts in the Commonwealth of Pennsylvania. If any of the Terms of Use is (are) held by a court of competent jurisdiction to be invalid, void, or unenforceable, then that term held to be invalid, void, or unenforceable shall be enforced to the maximum extent permissible so as to affect the intent of the Agreement and the remainder of the Terms of Use shall remain in full force and effect, and in no way shall be affected, impaired, or invalidated.

BOSS Controls seeks to respect user privacy and, in particular, personal information or personally identifiable information (separately and together, Personal Information) that enables BOSS Controls to identify you, such as your name, e-mail address, telephone number, and address. Generally, Personal Information is not automatically collected by visiting BOSS Controls’s Website; statistical or tracking information, however, may be automatically collected by use of the Website. Under certain circumstances, we may request Personal Information from you. Should you decline to provide such information, you may continue to use this Website, but you may not be able to submit inquiries or access certain options, offers, and services. It is important to understand that we may selectively send you information that may be of interest, either electronically or otherwise.
